CapsuLabs: Environmental Intelligence

Acceptable Use Policy

What you may and may not do with CapsuLabs Services

This Acceptable Use Policy ("AUP") supplements the Terms of Service and applies to every user of the CapsuLabs platform, including end-users, inspectors, B2B partners, and any third party accessing the Services through a partner's account. Violations may result in suspension, termination, and (for serious or repeated cases) civil or criminal referral.

1. Prohibited Conduct

You agree NOT to use the Services to:

Fabricate or alter inspection records

Generating reports for properties you have not actually inspected; altering FLIR / Protimeter values to misrepresent site conditions; back-dating or forward-dating timestamps; signing reports under credentials that are not yours.

Misuse forensic outputs

Presenting CapsuLabs reports as work product of a different inspector; representing simulation outputs as physical-measurement evidence in court; using the Services to stage insurance fraud or claims abuse.

Automate against the platform

Scraping, crawling, or bulk-extracting the species catalog, simulation engine, mold-literature database, or any other CapsuLabs intellectual property; running automated probes, fuzzers, or load-tests outside the documented vulnerability-disclosure scope.

Re-use lab or sensor data outside scope

Reselling or re-licensing lab analyses, ERMI/qPCR results, or sensor telemetry obtained through CapsuLabs to third parties; combining CapsuLabs data with externally-acquired data to identify natural persons against their consent.

Share credentials

Sharing logins, API keys, or session tokens with parties outside your organisation (including remediation contractors, realtors, or claim adjusters not named in your Order Form); creating shadow accounts to bypass per-seat licensing.

Reverse-engineer or derive competing products

Decompiling, disassembling, or extracting model weights from CapsuleAI; training a competing AI model on CapsuLabs outputs; replicating the species catalog or VTT scenarios in another product.

2. General Platform Abuse

You also agree NOT to:

  • Upload content that is illegal, defamatory, harassing, or that infringes another party's intellectual property;
  • Upload media containing identifiable persons without their consent (faces in inspection photos must be redacted before upload, except where the subject has signed a release);
  • Upload malware, exploit payloads, or any data intended to compromise CapsuLabs infrastructure or other customers;
  • Use the Services to send unsolicited bulk communications (spam) or to attempt phishing;
  • Bypass usage limits, quota enforcement, or rate-limiting through any means including but not limited to credential stuffing or distributed clients;
  • Misrepresent your identity, professional credentials (Industrial Hygienist licence, ASHRAE certification, etc.), or your authority to inspect a property;
  • Attempt to identify or de-anonymise data that has been anonymised for AI training (DPA §5).

3. Inspector-Specific Responsibilities

  • Site authority: only conduct inspections on premises where you hold the legal right of entry (owner permission, landlord authority, court order, or equivalent).
  • Subject consent: obtain written consent from occupants for any thermal imagery that captures interior spaces or personal effects. Stored consent records must remain accessible for the retention period defined in §5 of the Privacy Policy.
  • Lab chain of custody: respect the chain-of-custody protocol defined by the partner lab. Do not break sample seals, alter sample labels, or commingle samples between properties.
  • Health communication: do not communicate medical opinions or toxicology conclusions to occupants; refer them to a licensed clinician (see Health & Safety Notice).

4. Enforcement

  • Investigation: CapsuLabs reserves the right to investigate suspected violations, preserve evidence, and cooperate with law-enforcement or regulatory authorities where legally required.
  • Suspension: minor or first-time violations may result in a written warning and a remediation plan. Serious violations result in immediate suspension pending investigation.
  • Termination: confirmed serious violations result in account termination per the Terms of Service.
  • Civil & criminal referral: violations involving fabrication of reports, fraud, or attacks on infrastructure are referred to civil counsel and (where applicable) the Israeli Police, the relevant insurance fraud bureau, or competent EU authorities.
  • Reporting violations: report suspected AUP violations to legal@capsulabs.co.il. Reports made in good faith are protected from retaliation.

This AUP is incorporated into the Terms of Service by reference. Material changes follow the modification mechanic described in ToS §16 (consumer) or the Partnership Liability Addendum §5 (B2B partners).
